The allotment of Fair Price Shop (FPS) in favour of the petitioner was cancelled on certain allegations as stated in the order passed by the Sub Divisional Officer (Revenue), Bemetara, vide Annexure - P/1 dated 3-11-2017. The said order was affirmed by the Collector, Bemetara, however, while deciding the petitioner's second appeal the State Government has remitted the matter to the SDO for passing fresh order.

In this petition, the petitioner would pray that the self help group may be allowed to operate the FPS during pendency of the proceedings before the SDO.

The aforesaid prayer made by the learned counsel for the petitioner is objected by the learned counsel for the State. 4.
Considering the nature of allegations, ends of justice would be served if the writ petition is disposed of with direction to the SDO (Revenue), Bemetara, to complete the proceedings, in accordance with the direction issued by the State Government in its order dated 28-1-2019 at the earliest preferably within a period of six weeks from the date receipt of certified copy of this order.
