1. This is an application for condonation of delay in filing the MCC.
2. The MCC is barred by 1239 days.
3. It is stated in the application that when the appeal was dismissed for want of prosecution, an information was sent to the applicant, but he was out of station. Therefore, he could not instruct his counsel probably because he did not receive the information.
4. In the award impugned in the appeal under Section 173 of the Motor Vehicles Act, the applicant has been awarded compensation of Rs.8081/-.
5. Considering the entirety of circumstances, we are satisfied that the delay in moving the application for restoration is properly explained, therefore, the delay deserves to be condoned.
6. Accordingly, IA No.01 is allowed and the delay in filing the MCC is condoned.

7. This is an application for restoration of MAC No.951 of 2011 which was dismissed for want of prosecution on 11.04.2012.
