Both these bail applications are decided by this common order as they are arising out of the same crime number. 2.

The applicants have preferred these applications for grant of bail as they are arrested in connection with Crime No.53/2021 registered in Police Station Vidhan Sabha, Raipur, District Raipur (C.G.) for offence punishable under sections 354, 294, 323, 506, 509/34 of Indian Penal Code.

As per the prosecution case, on 07/02/2021 both the applicants have made obscene gestures to the prosecutrix, abused and threatened to kill her, thereafter went behind the temple and were showing their private parts to the prosecutrix and also assaulted the prosecutrix, thereby

tried to outrage her modesty.

Learned counsel for the applicants submits that due to previous enmity the applicants have been falsely implicated in the case, charge sheet has been filed, therefore the applicants may be released on bail. 5.

Learned State counsel opposes the prayer for grant of bail. 6.

Considering the nature of allegation, charge sheet has been filed and the fact that the offences are triable by JMFC, this court is inclined to release the applicants on bail.

Accordingly, both the bail applications are allowed and it is directed that the applicants shall be released on each of them furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
