At the outset, learned counsel for the petitioner submits that he be permitted to withdraw this petition with liberty to raise the issues taken in the instant petition before the trial Court as per observation recorded by the trial Court vide order dated 2.1.2016 as and when occasion arises, under the provisions of law. He further submits that while raising the said issues at the appropriate stage, appreciation and observation of the revisional Court made in Cr. Revision No.6/2016 vide order dated 11.3.2016 shall not come in the way.

Accordingly, the instant Cr.M.P. is disposed of as withdrawn without any appreciation on its merits reserving the aforesaid liberty as prayed for. 7.
