1. This writ petition is filed raising the issue as to whether the petitioner has substantially complied with the tender notification dated 14.02.2017 by submission of TDR (Fixed deposit) and solvency certificate issued by the State Bank of India.
2. When this matter taken up today, learned counsel appearing for respondent No.3-Municipality, states that he has instructions to submit that the tender notification referred to above will be cancelled and fresh notification will be issued, thereby paving way for the petitioner also to participate in consonance with the terms of the fresh notification.
3. Recording the aforesaid, this writ petition is closed directing that no further action shall proceed on the basis of the tender notification dated 14.02.2017.
4. Writ petition is ordered accordingly.
