1. Heard.

2. The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.845/2019 registered in Police Station Sarkanda, District- Bilaspur C.G. for the offence punishable under Sections 294, 323, 149, 506B, 302 of the I.P.C. and Section 25, 27 of the Arms Act.

3. Case of the prosecution, in brief, is that applicant along with other accused persons formed unlawful assembly and

MCRC No. 1647 of 2020 committed murder of deceased - Vikas Gupta.

4. Learned counsel for the State would oppose the bail application.

5. Considering eye-witnesses account stated to the Police by Karan Sinha, Gaurav Gupta, Ammu Yadav, Rajesh Ajgale and Rithik Pathak, I am not inclined to release the applicant on regular bail.

6. Accordingly, the bail application under Section 439 of the Cr.P.C. is rejected.
