Hon'ble Shri Justice P. Sam Koshy Order On Board 12/04/2017
1. The present petition was filed on 27.04.2012 seeking for pension, Gratuity and GPF amount and also for grant of compassionate appointment.
2. This court is inclined to dismiss the petition only on the ground of delay and laches. The Husband of petitioner No.1 died while serving in the
erstwhile State of Madhya Pradesh as early as on 21.03.1972. The present petition has been filed after more than 40 years from the date of death of the deceased employee. 40 years time is too long period for the respondents to maintain their records and come up with a stand justifying the claim of the petitioner. The petition is highly belated with no explanation whatsoever for the delay caused.
3. Accordingly, the petition is dismissed only on the ground of delay itself. Sd/- (P. Sam Koshy) Judge inder
