This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants who have been arrested in connection with Crime No.73/2016 registered at Police Station- Kanker, Distt. North Bastar Kanker (C.G.) for the offence punishable under Section 39, 44 & 51 of the Wild Life Protection Act.

Case of the prosecution, in brief, is that on a secret information received on 15.03.2016 that the applicants are looking for purchaser of the skin of Leopard, on being raid made, from the possession of the applicants one skin of Leopard was recovered. 3.

Learned counsel for the applicants would submit that the applicants have been falsely implicated in this case and no investigation has been made as to whether where-from the skin was procured. He further submits that the charge sheet has been

filed and no further investigation is necessary, therefore, the applicants may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents. Prima facie it appears that from the possession of the applicant, skin of Leopard was seized. This fact cannot be ignored that the Leopard & Tiger are in the verge of extinction and despite that fact and all efforts made by the Government, the offences are not being arrested. Considering the fact that the skin has been recovered from the possession of the applicants, I am not inclined to release the applicants on bail. 6.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is rejected.
