Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 02/08/2016 Heard.

1. The petition was filed by the petitioner at the stage when on account of pendency of departmental enquiry, pension case of the petitioner was not finalized. However, now, the departmental enquiry has been completed and the petitioner has been exonerated. Therefore, learned counsel for the petitioner submits that at this stage, the petition may be finally disposed off reserving liberty to revive in case grievance subsists.

Considering that the petitioner is a retired employee of 2011 and because of the departmental enquiry, the pension case could not be finalized, it would be expedient to dispose off the matter with a direction that now the pension case of the petitioner be expedited and within an outer limit of 4 months from the date of receipt of copy of this order, the entire pension case of the petitioner be finalized and the dues as may be found due and payable to the petitioner under the law, be paid to him at the earliest.
