1. In compliance of the order dated 10.1.2018, Mr.Dilip Kumar Jani, Assistant Personal Manager, Kuseria Colliery is present in the Court.

2. Learned counsel for the petitioner would submit that direction issued by this Court in WPS No.2/2012 has not been complied with by the SECL and one line order has been passed, which is unsustainable and bad in law.

3. On the other hand, learned Senior Counsel appearing for the respondents would submit that fresh order will be passed by the SECL in compliance of the order passed by this Court in WPS No.2/2012 within 45 days from today.

4. In view of the aforesaid submission, the impugned order

dated 20.5.2012 (Annexure P/14) passed by respondent No.2 is set aside. Respondent-SECL is directed to pass afresh order clearly stating as to whether the petitioner is entitled for family pension or not and whether policy of DOPT covered by circulars dated 6.9.2007 and 28.4.2011 is applicable to the petitioner or not.

5. The writ petition is allowed to the extent indicated hereinabove. No cost(s).
