1. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 02.01.2021 in connection with Crime No.05/2021 registered at Police Station Magarlod, District-Dhamtari (CG) for the offence punishable under Section 307 read with Section 34 of Indian Penal Code and Sections 25 & 27 of Arms Act.

2. Learned counsel for the applicant submits that since the complainant and other witnesses have been examined, therefore, at this stage he do not want to press this bail application.

3. Considering the submission made since the material witnesses have already been examined, this Court do not want to take on trial to give a finding which may affect the trial either of the prosecution or the defense. Accordingly, the bail application is dismissed as withdrawn.
