HIGH COURT OF CHHATTISGARH, BILASPUR MCRC No. 2965 of 2016 Partho Bala S/o Pranav Bala Aged About 21 Years R/o Hemu Nagar, P.S. Torba, Tahsil & District Bilaspur, Chhattisgarh. ---- Applicant
Versus
State Of Chhattisgarh Through P.S. Sarkanda, District Bilaspur, Chhattisgarh ---- Respondent For applicant - Shri Rajesh Jain, Advocate.
For Respondent/State - Shri Anant Bajpai, PL. Hon'ble Shri Justice Goutam Bhaduri Order 21/06/2016 1.
The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 308/2014 registered in Police Station Sarkanda, Bilaspur (C.G.) for offence punishable under section 392 R/w 34 of Indian Penal Code.
2.
As per the prosecution case the applicant on 2/07/2014 had snatched and looted one bag from the complainant Keshav Prasad Patel which was containing mobile, cash and certain documents. 3.
Learned counsel for the applicant submits that the applicant is in jail since 2 years and there is no progres in trial. Therefore, learned counsel submits that the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail. He submits that coordinate bench of this court has dismissed bail application of the co-accused and one case was registered against the applicant of similar nature of snatching.
5.
I have perused the case diary and the statement. It is alleged that applicant has snatched bags along with co-accused in the motorcycle.
Considering the nature of allegations and also for the fact that coordinate bench of this court has dismissed bail application of the co-accused, this court is not inclined to release the applicant on bail. 6.
Accordingly, the bail application is dismissed. However, liberty is reserved in favour of the applicant to move bail application again after six months.
