This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants who have been arrested in connection with Crime No. 557/2015 registered at Police Station- City Kotwali, District Mungeli (C.G.) for the offence punishable under Sections 302,492(A) and 324 of Indian Penal Code.

Case of the prosecution, in brief, is that the deceased Sangeeta Soni, succumbed to burn injury. The incident happened on 04.11.2015 and she died on 21.11.2015 and the report was made by the deceased herself against the applicant alleging that the applicant consumed liquor thereafter by pouring hot water on her which resulted into the said accident.

Counsel for the applicant submits that the deceased sustained only 12 percent burn injury and she admitted that the allegation can not be attributed to this applicant for committing murder, therefore, the applicant may be enlarged on bail.

Learned State counsel as well as counsel for the objector opposes the prayer for grant of bail.

Perused the statement of the deceased, she has attributed to the allegation to the applicant, considering the statement of the deceased and the nature of document, this Court is of the opinion, that present is not a fit case, in which, the applicant should be enlarged on bail.
