1. The claim of the petitioner seems to be the inaction on the part of the respondents in not deciding the application for compassionate appointment moved by the petitioner.

2. The father of the petitioner was working as N.A.M., Leprosy Control Unit, Government Hospital, Bemetara. He died in harness on 25.12.2004. The petitioner is said to have applied for compassionate appointment on 03.10.2006. Though the petitioner has moved the application as early as on 03.10.2006, till date the authorities have not finalized the said application of the petitioner for compassionate appointment.

3. The counsel for the petitioner submits that infact the District Collector at one point of time has already recommended for providing compassionate appointment to the petitioner, however, inspite of that no further decision have been taken by the authorities concerned.

Given the aforesaid facts and circumstances of the case, the writ petition at this juncture stands disposed of directing the respondents to consider and decide the claim application of the petitioner for compassionate appointment pending before the authorities concerned at the earliest preferably within a period of 60 days from the date of receipt of copy of this order. The decision to be taken by the respondent authorities have to be strictly in accordance with policy for compassionate appointment applicable on the date of death of the deceased employee.
