1. The present contempt petition has been filed alleging non compliance of the order dated 25.10.2018 passed in WPS No. 5252 of 2018.

2. The interim direction that this Court had given vide its order dated 25.10.2018 reads as under.

Given the aforesaid facts and circumstances of the case, let the respondent examine the case of the petitioner at part with the above said similarly placed person who has also charged for the same offence and take an appropriate decision at the earliest preferably within a period of 60 days so far as releasing of 100% pension is concerned

3. The respondent on notice has entered appearance and submitted that he has scrutinized the case of the petitioner and passed an order dated 03.04.2019 and as such the direction given by this Court stands complied with.

4. Having considered the document enclose with the reply by the respondent in the contempt petition, it appears that the matter has

been scrutinized by the officer of the Department and formal orders have also been passed on 03.04.2019.

5. In view of the decision taken by the respondent, this Court is of the opinion that the directions given by this Court as such stands complied with.

6. If at all, if the petitioner is not satisfied with the decision dated 03.04.2019, the petitioner would be at liberty to question the same in the pending writ petition i.e. WPS No. 5252 of 2018 and petitioner would also be at liberty to move appropriate application for any further directions that could be issued to the respondent in the light of the order dated 03.04.2019 in the said writ petition.
