The applicant is apprehending his arrest in connection with Crime No.12/2020 registered at police station-Panchpedi, Civil and Revenue DistrictBilaspur (C.G.) for alleged commission of offence under Section 354(घ) (1) (ii), 509 of the Indian Penal Code and Section 12 of the Protection of Children from Sexual Offences Act.

Prosecution case is that the applicant had been sending obscene messages to minor girl.

Learned counsel for the applicant submits that the allegations are exaggerated. The parties are related to each other. Later on, cordial relation has been resumed between both the family and mother of the prosecutrix has no objection to grant of anticipatory bail.

On the other hand, learned counsel for the State opposes and submits that the material collected by the prosecution makes out, prima facie, case that the applicant sent very obscene and dirty messages to the prosecutrix, who is barely 17 years old.

Having considered the submissions of learned counsel for the parties and material available on record, present is not a fit case for grant of anticipatory bail. The bail application is accordingly rejected. However, in case, applicant surrenders and files regular bail application, the same shall be decided, if possible, on the same day or in any case within three days.
