The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 33/2016 registered in Police Station Baikunthpur, District Korea (C.G.) for offence punishable under 354(A), 354(B) of Indian Penal Code and Section 8 & 18 of Protection of Children from Sexual Offices Act, 2012.

As per the prosecution case on 24/01/2016 when the prosecutrix came out of the house to answer call of nature, at that time the applicant caught hold of her and tried to outrage her modesty and on raising alarm the applicant fled away. Thereby, the offence is committed. 3.

Learned counsel for the applicant submits that the prosecutrix was in love affair with the applicant and since it was seen by the mother as such report was made after three days. Therefore, learned counsel submits that the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

I have perused the case diary. Considering the facts and circumstances of the case, charge sheet has been filed and the applicant

is in jail since 1/02/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
