Above mentioned three bail applications arise out of a common Crime No. 214/2018 registered at Police Station Devendra Nagar, Raipur District Raipur for the offence punishable under Sections 419, 420 of IPC and Sections 66, 66(B), 66(C), 66(D) of I.T. Act, therefore, they are being heard analogously and decided by this common order. All the bail applications filed under Section 439 of CrPC.
2. Perused the case diary provided by the learned counsel for the State.
3. Case of the prosecution, in brief is that Vyavasayik Sahkari Bank has two saving accounts in Yes Bank at Civil Lines, Raipur. On 06/11/2018 after the office time Rs. 440.53 Lacs were balanced in said saving accounts. When on 08/11/2018 in the morning the balance amount was tallied Rs.2.47 Crores were deficient. Some unknown persons had transferred said amount in 26 accounts of different bank accounts after hacking of said saving accounts. On 07/11/2018 Rs.2 Lacs were transferred in Account No. 918010038093226 which belongs to applicant Ajit Rai. On 08/11/2018 Rs.10 Lacs were transferred in Account No. 5711917777 which belongs to applicant Bittu. On 07/11/2018 Rs.10 Lacs were transferred in Account No. 0725104000141338 which belongs to applicant Ilyas Ahmed Khan Deshmukh.
4. Counsel for the applicants submitted that applicants had no knowledge about respective accounts. Co-accused Lalan Singh had obtained documents from them saying that those documents are required to update the Aadhar Card. Number of pass-books, ATM transaction ID, Computer and all other relevant documents have been seized from him, therefore, they shall be released on bail.
5. On the other hand, counsel for the State opposes the bail application. He further submits that no criminal antecedents against the applicants.
6. Looking to the above mentioned facts and circumstances of the case, looking to shortage of huge amounts, looking to the seriousness of the alleged offence, looking to the impact of granting bail to the applicants on society, the present bail applications are rejected.
