2. The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.80/2019, registered at Police Station Shankargarh, District Balrampur-Ramanujganj (CG), for the offence punishable under Section 302 read with Section 34 of the Indian Penal Code.

3. Present applicant and co-accused Manbodh Urao committed murder of Charan Ram (since deceased) by injuring him by

means of club and axe (tangi). On the memorandum statement of present applicant axe has been recovered. The incident has been witnessed by Smt. Bano, wife of Charan Ram (deceased).

4. Although the co-accused Manbodh Urao has been released on bail, however, the allegation of causing fatal assault by axe has been attributed to the present applicant, therefore, this Court is not inclined to grant bail to the applicant.
