Learned counsel appearing on behalf of the appellant submitted that as instructed, the appellant served the entire sentence and released after availing benefit of remission thereby completed his sentence and as instructed he does not want to contest the appeal on its merit.

The appellant is not pressing that the appeal be heard and disposed of on merit. Even after perusal of the entire evidence I do not see any illegality and infirmity regarding the conviction and sentence passed by the trial Court against the appellant.

Consequently, the appeal filed by the appellant is hereby dismissed upon consideration of entire merit and also as prayed on behalf of the appellant that he does not want to contest the appeal on its merit. 4.

Appeal dismissed.
