1. Proceedings of this matter have been taken-up through video conferencing.
2. Mr.Shantanu Awasthi, learned counsel for the petitioners, would submit that the petitioners were earlier working on the post of Sub Auditor on pay scale of Rs.4000-5000/-, whereas pay scale of Internal Account Audit and Taxation Officer is Rs.4500-7000 and pay scale of Senior Internal Account Audit and Taxation Officer is Rs.5000-8000 though they are in junior posts. Therefore, such a pay fixation is arbitrary and illegal. However, since most of petitioners have retired, they may be allowed to make a representation to the State Government for giving pay scale at par with those officers.
3. Prayer appears to be fair and reasonable.
4. The petitioners are allowed to make a representation within 30 days from today before the State Government claiming rectification in pay scale and for grant of higher pay scale at par with those officers, which will be considered by the State Government within next 60 days from the date of receipt of representation by passing a reasoned and speaking order in accordance with applicable rules and regulations.
5. With the aforesaid observation / direction, the writ petition finally stands disposed of. NO order as to cost(s).
