Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 13-31. This is first bail application under Section 439 of the Cr.P.C. preferred by the applicants before this Court and his no bail application is pending before any other court.
2. The applicants have been arrested in connection with Crime No. 240/2018 registered in police station Nagarnar, Jagdalpur, Distt. Bastar (CG) for offence punishable under Section 20-B of the NDPS Act.
3. Perused the case diary.
4. Prosecution story in brief is that on 5-12-2018, Sub Inspector Sudhram Netam posted at Police Station Nagarnar seized 9 kg of cannabis from joint possession of the applicants.
5. Counsel for the applicants argued that the applicants are innocent and have been falsely implicated hence they be released on bail.
6. On the other hand, the State Counsel opposed the bail application. He further submits that no criminal antecedent has been reported against applicants in the police case diary.
7. Looking to the above facts and circumstances of the case, as the trial will take its own time, the application is allowed. It is ordered that if each of the applicants furnishes one solvent surety for a sum of Rs. 25,000/- along with one personal bond of the 25,000/- to the satisfaction of the trial Court concerned, they be released on bail.
