The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 70/2016 registered in Police Station Dharsiva, District Raipur (C.G.) for offence punishable under 20 (B) of NDPS Act.

As per the prosecution case on 10/03/2016 on information received that applicant is in possession of cannabis, on raid being conducted from his possession 1.300 kg of cannabis was recovered and the offence is committed.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case and charge sheet in this case has been filed and the cannabis so seized were not properly sealed and it is not proved that said goods were cannabis. Therefore, learned counsel submits that the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the fact that charge sheet has been filed. Taking into fact that quantity of cannabis so seized is 1.300 kg and also for the fact
that applicant is in jail since 10/03/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
