The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No.74/2019 registered in Police Station Nagri, District Dhamtari (C.G.) for offence punishable under sections 302, 201, 120-B r/w section 34 of Indian Penal Code. 2.

As per the prosecution case, the applicant who is wife of deceased Rakesh Sonwani alongwith co-accused committed murder for the reason that the applicant and the other co-accused were in relation for few years which was objected by the deceased/husband of the applicant. 3.

Learned counsel for the applicant submits that the dead body of the deceased was found in open road and there is no direct evidence except the memorandum statement and the other co-accused Dikesh Kumar Ratre has been enlarged on bail by the co-ordinate bench in M.Cr.C. No.971/2021 on 10/02/2021, therefore the present applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail and submits that there are total three accused persons and the mobile call

detail match with the memorandum which prove the conspiracy. 5.

Considering the submission and the fact that other co-accused have been enlarged on bail, without further observation on the merit of the admissibility of the evidence, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on her furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for her regular appearance before it as and when directed.
