1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.9/2020 registered at Police Station Lormi, District Mungeli, for offence punishable under Sections 354 & 323 of the Indian Penal Code.

2. Applicant has allegedly outraged the modesty of the victim by touching her hand. He has also caused simple injury to the victim.

3. Learned counsel for the applicant would submit that the parties are neighbours and a simple incident of marpeet had occurred for which the applicant's family has lodged a report, therefore, as a counter blast the present report has been lodged.

4. Learned State Counsel would oppose the prayer for grant of bail.

5. It appears the parties are neighbours and had minor dispute between them.

6. Considering the entire facts situation of the case and for the fact that there appears to be a simple marpeet in which the applicant might have accidentally touched the hand of the lady and also for the fact that custodial interrogation does not appear to be required, this Court is inclined to release the applicant on anticipatory bail.

7. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (a) he shall make himself available for interrogation by a police officer as and when required;

(b) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
