The petitioner has filed this writ petition stating inter alia that he is entitled for promotion on the post of Training Superintendent and he has not been given promotion.

Learned Panel Lawyer for the State would submit that on account of Annual Confidential Report of the year 2009-10 the petitioner was not found fit for promotion, which was duly

communicated to him.

Fact remains that the petitioner has suffered the penalty envisaged under Rule 10 of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966 and he has granted liberty to prefer an appeal before the Appellate Authority in WP(S) No.1721 of 2011 on 4.1.2016 by this Court. 4.

In view of above, the petitioner is at liberty to make afresh representation against order rejecting his representation for expunging adverse remark depending upon the outcome of the appeal.

With the aforesaid observation, the writ petition finally stands disposed of. No order as to cost(s).
