1. Heard.

2. This is the Second Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 26.09.2016 in connection with Crime No. 560/2016 registered at Police Station Supela Thana, District Durg (CG) for the offence punishable under Sections 420, 409, 120 B read with 34 of Indian Penal Code and Sections 3, 4, 5 & 6 of the Price Chits and Money Circulation Scheme (Banning) Act, 1978.

3. The first bail application bearing M.Cr.C. No.4033 of 2019 was dismissed on

12.07.2019.

4. On the earlier date of hearing on 22.06.2020 learned State counsel was directed to verify the fact that as to how many witnesses have been examined till date.

5. Learned counsel for the applicant submits that no witness has been examined till date, therefore, the applicant may be released on bail.

6. Learned State counsel, on instructions, is not able to dispute the submission made by learned counsel for the applicant.

7. Considering the fact that the applicant is in jail for the last 3 years and 9 months and till date no evidence has yet started, therefore, since the applicant is in jail for a considerable time, I am inclined to release the applicant on bail.

8. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court. SDSd/-/- Goutam Bhaduri Judge Ashu
