1) Petitioner has preferred this writ petition seeking a direction to the respondent No.3 to consider his appeal preferred against the order of suspension and to allow him to remain in his headquarter at Baikunthpur, in the office of the Director, Guru Ghasidas National Park.

2) Admittedly, the petitioner, who is working as Assistant Grade III, has been suspended by order dated 25-2-2015 passed by the respondent No.4, against which the petitioner has preferred an appeal before the respondent No.3 on 1-4-2015.

3) Since the appeal is pending and two parallel proceedings on one issue is not permissible, the writ petition is disposed of with a direction that if the petitioner's appeal is still pending, the appellate authority i.e. respondent No.3 shall consider and decide the petitioner's appeal in accordance with law and on its own merits as early as possible preferably within a period of three months from the date of submission of certified copy of this order. 4) It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the appeal, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
