As per the petitioner a proceeding under Section 89 of the C.G. Land Revenue Code was commenced in the month of November, 2018. SDO (Revenue), Korba called for certain report from the Naib Tehsildar and Tehsildar. The report though was prepared but it is not being forwarded to the SDO. In a result proceeding under Section 89 of the C.G. Land Revenue Code cannot be concluded.

Learned counsel for the petitioner would submit that under the circumstances SDO be directed to conclude the proceeding within a reasonable time.

On the earlier occasion State counsel was granted time to seek instruction, however today also instructions are awaited. 4.

Considering the nature of prayer made, only prayer is made to

conclude the proceeding under Section 89 of the C.G. Land Revenue Code by the SDO within a reasonable time. Perusal of the documents would show that proceeding commenced in the year 2018 and till date it is pending. Taking into such fact and the document which shows that certain report were prepared at the end of the Naib Tehsildar and Tehsildar meaning thereby prima facie shows that considerable progress has already been done, therefore SDO is directed to conclude the proceeding which commenced by Annexure P-1 on 30/11/2018 under Section 89 of the C.G. Land Revenue Code within a further period of 45 days from the date of receipt of this order.
