This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 109/2012, registered at Police Station Kotwali, Raipur (C.G.), for the offence punishable under Sections 302, 307, 120-b Rd/w 34 of I.P.C. and 25, 27 Arms Act. 2.

Case of the prosecution, in brief, is that deceased Dilip Adani died on account of gunshot injury made by the applicant and five other co-accused persons.

After hearing learned counsel appearing for the parties and taking into consideration the gunshot injury said to have been received by deceased and recovery of pistol from the present applicant, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
