Learned counsel for the petitioner submits that the petitioner has filed a representation for his consideration to the post of Naib Tahsildar in pursuance of the examination conducted by the respondent-CGPSC as he stood at the top of the wait list. The candidate who was selected for the Naib Tahsildar has declined to join the said post and thus, the candidature of the petitioner being at the top of the wait list should have been considered for selection and appointment.

Learned Counsel for the respondent-CGPSC submits that the petitioner has not challenged the recruitment process and neither can he claim appointment merely being in the wait list.

Be that as it may, it is for the respondent-CGPSC either to fill up or not to fill up the vacancies available from the candidates in the wait list. The petitioner has no indefeasible right to claim appointment merely on the basis of his name being reflected in the wait list. The petitioner ought to have waited for the decision on his

representations and after the decision, if any grievance still remains, it is open for the petitioner to take appropriate steps under the law.

With the aforesaid observation, this petition stands disposed of.
