The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.47/2016 registered in Police Station Pandari Raipur Civil and Revenue District Raipur (C.G.) for offence punishable under section 379 r/w 34 of Indian Penal Code. 2.

As per the prosecution case on 26/02/2016 a report was made by father of Kumaraswami namely Karupaiya that he has parked his motorcycle bearing No. C.G.04/HN 5930 in front of Geeta Grocery shop and after coming back he saw that someone has taken away his motorcycle.

Learned counsel for the applicant submits that the applicant has not committed any offence and he has been falsely implicated in the case, charge sheet has been filed, no further evidence is required, therefore, learned counsel submits that the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perusal of the document would show that from the possession of the applicant the motorcycle was seized. Considering the wide theft of the

two wheelers and the proximity of time, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
