1. Petitioner has filed an application before the trial Court seeking no objection for renewal of his passport which has been rejected by the trial Court on the ground that CRMP No. 590/2016 preferred by the petitioner is pending consideration and the interim order is also operating staying further proceedings of the trial against which this WPCR No. 146/2020 has been preferred.
2. I have heard learned counsel for the parties. The application is strongly opposed by learned Assistant Solicitor General.
Since interim order is operating the trial Magistrate is justified in declining.
3. Considering the above, the interim order dated 07.06.2016 is modified and trial Court is directed to consider the application dated 05.12.2019 for granting no objection for renewal of petitioner's passport in
accordance with Circular dated 25th August, 1993 and order passed by this Court in WPCR No. 1030/2019 (Abhishek Tiwari v. Union of India & Ors.) decided on 06/11/2019.
4. In view of the above observations/directions the instant petition stands disposed of.
