Petitioner would assail the order of transfer passed by the Department of Urban Administration and Development on 11.04.2017 transferring him in the same capacity as Assistant Grade-II from Municipal Corporation, Raigarh to Municipal
Corporation, Ambikapur.

It is argued that the petitioner has been transferred during the ban period without the matter being taken for orders on coordination. It is also argued that the petitioner would lose his seniority at the transferred Corporation, which may ultimately adversely impact his chances of promotion.

Considering the entire facts situation of the case, the writ petition is disposed of with direction that in the event, the petitioner prefers representation before the Secretary, Department of Urban Administration and Development within a period of one month from today, the said Secretary shall consider and decide the representation within next 3 months.

Till the representation is decided, the effect and operation of the impugned order in respect of the present petitioner shall remain stayed.
