1. In the instant Writ Petition, the petitioners have been working with the Municipal Corporation, Bilaspur since 1992 onwards.
2. According to the counsel for the petitioners, the respondents have now initiated a step for regularizing the employees who are working with the respondents for long. He refers to Annexure P/7 which shows that, the respondent No.3 has already forwarded the names of a bunch of employees working with the respondent No.3 as Daily Wage Employees for regularization. According to him, the petitioners are also similarly placed and no reasons have been assigned as to why the names of the petitioners have been left out from being considered for regularization. He further contended that, from among the persons whose names have already been recommended by the respondent No.3, many of them are appointed much after the names of the present petitioners have been appointed.
3. Given the aforesaid facts and circumstances of the case, let the respondent No.3 consider the case of the petitioners also and take a decision as to whether the petitioners also are similarly placed or not
-3as compared to the persons whose names have already been forwarded by the Corporation.
4. It is expected that, the respondents while sending the names of the employees for regularization would definitely keep in mind the seniority of the persons who have been engaged as Daily Wage Employees in the department subject to the candidates fulfilling the minimum eligibility criteria in respect of the post against which they are likely to be regularized.
5. Let the respondent No.3 take a decision so far as the case of the petitioners are concerned within a period of 60 days from today.
