Also heard on I.A. No.2/2020, application for grant of ad-interim bail.

The applicant has been arrested in connection with Crime No.204/2018 registered in Police Station Gandhi Nagar, District Surguja (CG) for offence punishable under Sections 363, 366, 376(n) of IPC and Sections 4, 5(1), 6 of POCSO, Act.

As per contents of I.A. No.2/2020, the applicant is sole bread earner of his family and looking to the situation of COVID 19 (CORONA), he may be released on ad-interim bail.

There are no sound grounds for grant of ad-interim bail to the applicant, hence I.A. No.2/2020 is rejected.

Earlier while dealing M.Cr.C. No.9939/2018, this Court has granted bail to the applicant on 05.02.2019. On 10.02.2020 Additional Sessions Judge, Fast Track Special Court (POCSO Act), Amibkapur, District Surguja cancelled the bail and bond of the applicant due to his nonappearance.

If earlier order of this Court has not been cancelled either by this Court or Superior Court then such order is still alive and the applicant is free to furnish another surety and bond before the trial Court in compliance of order of this Court dated 05.02.2019. If another surety and bond are furnish by the applicant then the trial Court to keep this fact in his mind that whether earlier order of this Court has been cancelled or not.

M.Cr.C. is accordingly disposed off.
