1. Petitioner has prayed for payment of salary for the period of suspension from 28.07.2010 to 26.08.2014, however, perusal of the order Annexure P-2 passed by the Collector (Land Record) on 26.08.2014 would reveal that non-payment of salary for the said period is a part of punishment imposed on the petitioner at the end of the departmental enquiry constituted against him. An order of releasing salary for the above said period can only be made if that part of the order Annexure P-2 is set aside, but the petitioner has not made any such prayer in the writ petition. Even otherwise, the order Annexure P-2 is appealable under Rule 23 of the Chhattisgarh Civil

Services (Classification, Control & Appeal) Rules, 1966 (for short 'the Rules, 1966).

2. Let the petitioner prefer duly constituted appeal before the appellate authority under Rule 23 of the Rules, 1966 within a period of one month, thereafter the appellate authority shall consider the same on its own merits.
