This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.48/2016 registered at Police Station- Moudhapara, Raipur (C.G.) for the offence punishable under Section 498-A/34 of Indian Penal Code and Section 4 of Dowry Prohibition Act.

Case of the prosecution, in brief, is that a complaint was made by one Smt. Sonam Thakur that the complainant was married to the present applicant on 19.11.2013 and out of the wedlock a child was born and subsequently she was subjected to torture for demand of dowry as the girl child was born. Ultimately the report was made. 3.
Learned counsel for the applicant would submit that the applicant has been falsely implicated and the charge sheet in this case has been filed. He further submits that taking into the allegations made, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary which contains the conciliation proceeding. Taking into the statement and the fact that the charge sheet has been filed and further considering the nature of allegation and degree of offence and the fact that the trial may take some time, I am inclined to release the applicant on bail. 6.
Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed. Sd/- (Goutam Bhaduri) Judge Ashok
