The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.483/2020 registered in Police Station Kotwali Jagdalpur, District Baster Chhattisgarh. (C.G.) for offence punishable under section 392, 34 of Indian Penal Code. 2.
As per the prosecution case, on 31/10/2020 while the complaint Ratan Mourya was going at about 11 pm he was dashed with a motorcycle and three persons assaulted him and looted Rs.5500/-. 3.
Learned counsel for the applicant submits that the complainant has been examined and he has not identified the present applicant. He placed on record the statement of Ratan Singh Mourya. Learned counsel submits that therefore the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail and would submit that money was recovered from the present applicant. 5.
Considering the fact that complainant Ratan Singh has been examined, prima facie it appears that he has not identified the present applicant, without any further observation on the merit, considering the facts of this case and nature of allegations, this court is inclined to release
the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
