1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.49/2019, registered at Police Station Khamardhi, Raipur for offences punishable under Sections 420, 467, 468, 471, 34 of the IPC.

2. The applicant is a broker who mediated between Gokul Prasad Sahu and purchasers for sale of his land situated at Mauja Bhavna Nagar Khamhardeeh, Patwari Halka No.110/63 Shankar

MCRCA No. 374 of 2020 Nagar, Raipur. While the sale deed was executed for land belonging to co-accused Gokul Prasad Sahu, the purchasers were handed over the possession of land belonging to complainant Manoj Balecha, thus the land belonging to Manoj Balecha was sold by Gokul Prasad Sahu through the present applicant, who is a broker. Applicant is also a witness to the sale agreement.

3. Learned State Counsel would oppose the prayer for grant of bail.

4. Considering the nature of dispute and the role attributed to the applicant in the entire transaction, this Court is inclined to extend the benefit of anticipatory bail.

5. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (I) he shall make himself available for interrogation by a police officer as and when required;

(ii) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
