The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.482/2020 registered in Police Station Kotwali Jagdalpur, District Baster Chhattisgarh. (C.G.) for offence punishable under section 392, 34 of Indian Penal Code. 2.

As per the prosecution case, a report was lodged by complainant Wajid Amin that on 31/10/2020 at about 11 pm while he was going the present applicant alongwith others have looted Rs.10,000/-. 3.

Learned counsel for the applicant submits that the complainant Wajid has been examined and he has not identified the present applicant, therefore no case is made out, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail and would submit that money was recovered from the present applicant. 5.

Statement of Wajid has been placed wherein it appears that he has not identified the present applicant. Considering the fact that the applicant has not been identified, without further observation on the merit, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
