Proceedings through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 26/06/2020

1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.31/2020, registered at Police Station Urga, District Korba C.G. for offences punishable under Sections 498-A (as per the provision), 294, 506, 34 of the IPC.

2. Applicant's son namely; Bhawani Patel was married to the complainant on 28.04.2017. According to the applicant his

daughter-in-law went to her parental house, therefore, a report was lodged on 10.07.2018 but no action was taken and it was informed that the matter was filed under Section 155 of the Cr.P.C. As the dispute subsisted, the matter was processed before the Family Conciliation Center. However, the complainant refused to live with her husband vide proceedings dated 01.05.2019. In the meanwhile, she filed 125 Cr.P.C. proceedings on 12.04.2019 and the present FIR was lodged on 10.02.2020.

3. Learned State Counsel would oppose the prayer for grant of bail.

Although, there are allegations that applicant was involved in ill-treating his daughter-in-law, the fact remains that the dispute between the husband and wife was going on since at least from July, 2018 but the FIR was lodged in February, 2020 and the applicant is an elderly person aged about 65 years, this Court is inclined to extend the benefit of anticipatory bail.

Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:-

(I) he shall make himself available for interrogation by a police officer as and when required;

(ii) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
