Shri Satish Gupta, Govt. Advocate For Res. No. 4 :
Shri M.H. Baig Advocate S.B. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 11/08/2017 Heard.
1. In this petition, an order of transfer by way of deputation passed on 9.10.2014 has been assailed.
2. This Court passed an interim order staying the effect and operation of the transfer order. An application for vacating interim order was also filed and was also rejected. In this manner, because of the interim order, the petitioner is continuing at the present place of posting since last three years and the impugned order has not been given effect to.
-23. Therefore, in view of the above circumstances and considering that it is only a transfer matter, I am inclined to dispose off this petition at this stage with a direction that the impugned order shall not be given effect to. However, it will always be open for the respondent- State to pass the order of transfer as and when administrative exigency of service and public interest arises.
4. The petition is accordingly disposed off.
