The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.45/2016 registered in Police Station Kunkuri, Distt. Jashpur (C.G.) for offence punishable under sections 409, 120B, 34 of Indian Penal Code, 1860.

As per the prosecution case, the applicant who was working as Manager in Aadim Jati Seva Sahkari Samiti Maryadit, Kunkuri in between period from 10/01/2014 to 5/08/2015 siphoned money of Rs.16,97,160/- along with other co-accused though amount was deposited by different farmers.

Learned counsel for the applicant submits that the applicant was not in-charge to receive the amount, infact cash was being received by the cashier and farmers too have not deposited the amount, therefore applicant has been falsely implicated in this case. He submits that charge sheet has been filed, no further investigation is necessary, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and the documents. Taking into documents in the case diary as appears the evidence is mostly in documentary nature, considering the fact that charge sheet has been filed, no further investigation is necessary and also for the fact that the applicant is in jail since 2/03/2016, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
