After arguing for sometime, Learned counsel for the petitioner seeks permission to withdraw this petition with liberty to raise the objection before the trial Court regarding the maintainability and legality of the trial conducted against the petitioner in view of the provisions under Section 197 of the Code of Criminal Procedure.

Learned State counsel has no objection to the submission made in this respect.

The trial Court is also directed to consider the objection raised by the petitioner before proceeding further in the trial. 5.
Registry is directed to return certified copy of the impugned order, after keeping the authenticated true copy.

In view of above, this petition is dismissed as withdrawn with the aforesaid liberty.
