1. The claim of the petitioner in the present writ petition is for appropriate direction to respondents to consider the case of the petitioner for regularization in the light of the judgment of the Supreme Court in the case of Secretary, State of Karnataka and others Vs. Uma Devi (3) and others, 2006 (4) SCC 1 and also the subsequent decision of the Supreme Court in the case of Narendra Kumar Tiwari and others. Etc. V. State of Jharkhand and others Etc., AIR 2018 SCC 3589 and other judgment in the case of Sheo Narain Nagar and others V. State of Uttar Pradesh and others in AIR 2018 SCC 233.
2. Given the facts, this Court is of the opinion that no fruitful purpose would be served in keeping the writ petition pending rather ends of justice would meet if the writ petition stands disposed off with a direction to respondent No. 1 to consider the case of the petitioner for regularization in accordance with the circulars if any in respect of the regularization applicable in the department. While considering the same respondents would also keep in mind the seniority of the petitioner and other similarly placed persons and also the judgments of the Supreme Court as referred above.
3. It is expected that the respondents, would take a decision in this regard at the earliest preferably within a period of four months from the date of receipt of copy of this order.
