1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of bail to the applicant in Crime No. 926/2020 registered at P.S. Kotwali Raigarh, Distt. Raigarh for the offence punishagble under sections 420, 467, 468, 469, 471, 34 of IPC.
2. As per the prosecution case, the applicant along-with other accused obtained money of Rs.26,68,020/- to provide admission to the daughter of complainant namely Dr. Ved Prakash Patel in a medical college. The applicant was apprehended when he again came to collect the part of the amount and from him, the cash was seized and 3 separate identity cards were also recovered from him. Apart from that, it shows that the applicant took the girl to Ranch to get her admitted in Medical College, Ranch, where he handed over the money to another person and eventually, the receiver of such amount as also certain gang was also
involved in the offence. The other accused persons are still absconding.
3. Learned counsel for the applicant submits that the money has been recovered and the present applicant has been falsely implicated in the case. He further submits that the applicant is in jail since 29.11.2020 and charge sheet has been filed, therefore, he may be enlarged on bail.
4. Learned State Counsel opposes the bail application.
5. Considering the fact that the other accused are still absconding and the way the offence has been committed, I am not inclined to allow this application. Accordingly, this bail application is dismissed. The trial Court may expedite the trial.
