Counsel for the applicant prays for withdrawal of the revision petition with a liberty to file an appropriate CrMP against the impugned order dated 07/05/2007, whereby the respondent No.1 has been acquitted for the offence under Section 138 of the Negotiable Instrument Act.

Counsel for the applicant submits that the present petition has been wrongly filed under the wrong provisions of law and therefore he prays for withdrawal of the same so that the proper remedy can be availed.

As prayed for, the revision petition is dismissed as withdrawn with the aforesaid liberty.

Subject to the petitioner filing photostate copy of impugned order the original certified copy shall be returned back to the petitioner.
