1. Learned counsel for the petitioner would submit that although the petitioner has been allowed benefit of time bound pay-scale, however, the arrears thereof has still not been paid. He would also submit that the petitioner is entitled to certain amount under the leave encashment and for both of the reliefs he has filed representation, which has not yet been decided.

2. Considering the entire facts situation of the case, the writ petition is disposed of with direction that in the event the petitioner prefers fresh representation before the competent authority within a period of one month

from today, the said authority shall decide the representation, on its own merits, at the earliest, preferably within a period of three months from the date of submission of representation.

3. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
