2. Learned counsel for the petitioner would submit that the petitioner's application for compassionate appointment is not considered for the reason that on account of death of petitioner's mother in the year 1992, his brother Punaram Sahu was granted compassionate appointment. He would further
submit that the petitioner's brother was granted compassionate appointment about 25 years back, but his brother is not a member of the joint family, as after marriage, he has separated and maintaining his own family, which is proved from the Family Ration Card filed along with the Declaration Form in Appendix-II of the application. It is also put-forth that similarly placed candidates namely Sushila Bai and Gowrishankar Yadav have been appointed in the same Division at PWD.

Considering the entire facts' situation of the case, the writ petition is disposed of with a direction that in the event, the petitioner prefers fresh application before respondent No.2 within a period of one month from today, the said authority shall consider the application afresh in accordance with law keeping in view of the orders passed in favour other similarly placed candidates.
